An Affidavit Is Not a Substitute for an Apostille on an Educational Document

If you plan to have your educational documents recognised abroad for the purposes of further study or employment, we recommend paying particular attention to the procedure for obtaining an apostille.
Please note that, in accordance with Resolution No. 61 of the Cabinet of Ministers of Ukraine of 18 January 2003, "On the Authorisation to Affix the Apostille Provided for by the Convention Abolishing the Requirement of Legalisation for Foreign Public Documents", Ukrainian educational documents must be apostilled by the Ministry of Education and Science of Ukraine before they can be used abroad.
Recently, the Centre has received an increasing number of requests from competent recognition authorities in other countries to verify the authenticity of Ukrainian educational documents accompanied by notarised affidavits (statements made by the document holder) bearing an apostille issued by the Ministry of Justice of Ukraine.
During such verifications, the Centre's specialists have identified cases where educational documents supported by affidavits were found to be either forged or issued in violation of the legislation of Ukraine. At the same time, those affidavits bore an apostille issued by the Ministry of Justice of Ukraine.
It is important to understand that an apostille issued by the Ministry of Justice of Ukraine and affixed to a notarised affidavit certifies only the authenticity of the notary's signature and the notary's authority to certify the relevant statement.
Competent recognition authorities in other countries contact the Centre to verify that an educational document was issued by the authorised institution, that the information it contains is accurate, and that it has been properly issued in accordance with the requirements of Ukrainian legislation. The Centre carries out this comprehensive verification before the Ministry of Education and Science of Ukraine affixes an apostille to the educational document.
We therefore recommend obtaining an apostille issued by the Ministry of Education and Science of Ukraine on the original educational document before using it abroad.
If the original educational document is lost or damaged, Ukrainian legislation allows for the issuance of a duplicate educational document. A duplicate may also be issued where access to the archives of educational institutions is unavailable, including those located in the territories of Ukraine temporarily occupied by the Russian Federation.
